Terms of Service

These Terms of Service govern your access to and use of ViralBatch. By creating an account or using the service, you agree to these Terms. If you use ViralBatch for an organization, you represent that you have authority to accept these Terms for that organization.

If you do not agree, do not use the service. These Terms do not remove rights that cannot be waived under applicable law.

You must be legally able to enter this agreement. You must provide accurate registration information, complete any required email confirmation, protect your credentials and sessions, and promptly tell us if you believe your account has been compromised.

You may not share or use accounts to evade service, payment, credit, referral, access, or security controls. Some privileged administrative access is subject to additional authentication and authorization safeguards.

ViralBatch provides tools for creating and managing AI-generated product videos. Current features can include Products and Product media, third-party Product imports, prompts, reusable Formulas, Batches, generation settings, optional off-screen narration, asynchronous AI video generation, generation history, a media Library, credits, monthly subscriptions, and Pay As You Go purchases.

Available features, Formulas, modes, durations, resolutions, storage allowances, and provider-backed capabilities may change. ViralBatch does not guarantee a particular output, generation time, sales result, conversion rate, social-platform performance, or compatibility with every Product or third-party source.

“User Content” includes Product information, images, clips, source URLs, uploaded media, brand materials, prompts, narration scripts, reference media, Batch settings, and other material you submit, import, or select for processing. You retain the ownership and other rights you already have in User Content. ViralBatch does not acquire ownership merely because you use the service.

You represent that you have the rights, licenses, consents, and permissions necessary to upload, import, process, transform, and use User Content. This includes rights concerning products, brands, trademarks, people, likenesses, audio, video, and third-party source material.

You grant ViralBatch and the service providers needed to operate the service a limited license to host, store, reproduce, process, transmit, analyze, and transform User Content only as reasonably necessary to provide, secure, operate, support, and improve ViralBatch and fulfill your requests. This license does not grant a general right to use your Product media in advertising.

ViralBatch uses automated and AI systems to analyze inputs and generate media. Depending on the feature, images, reference video, prompts, settings, and exact narration scripts may be transmitted to AI and media-generation service providers to complete your request.

Generated output can vary and may contain inaccuracies, artifacts, unexpected elements, or material unsuitable for your intended use. Outputs are not guaranteed to be unique, and similar or identical material may be produced for others. ViralBatch does not guarantee that output is accurate, non-infringing, legally protectable, or cleared for a particular commercial use.

You are responsible for reviewing output before publishing, distributing, advertising, or relying on it, and for complying with applicable laws, intellectual-property and publicity rights, advertising disclosures, and third-party platform rules.

At your request, ViralBatch can retrieve public Product information, variants, and images using a supported Product URL, identifier, or public TikTok Shop showcase. Imported material remains subject to the source platform's terms and third-party rights. You are responsible for ensuring that you are authorized to request, store, process, and use it.

ViralBatch is not affiliated with TikTok merely because it supports Product import. We are not responsible for a third-party platform's availability, API or service changes, inaccurate source data, or violations of third-party terms caused by your conduct. ViralBatch does not provide automated TikTok posting.

You may not use ViralBatch to:

• violate law or third-party rights;
• upload, import, or generate material without the required rights or permissions;
• engage in fraud, deceptive abuse, impersonation, exploitation, or malicious activity;
• gain unauthorized access to an account or probe, bypass, disable, or interfere with security or access controls;
• evade payment, credit, usage, provider, or referral controls;
• create fake accounts, self-refer, manipulate payments, or abuse the referral program; or
• distribute malware, overload infrastructure, scrape private areas, or materially interfere with operation of the service.

Do not submit private or sensitive information unless it is necessary for your requested use and you are authorized to process it. We may investigate suspected misuse and restrict access when reasonably necessary to protect users, third parties, or ViralBatch.

ViralBatch relies on service providers for authentication, databases, hosting, compute, private media storage, payment processing, account email delivery, Product-data retrieval, AI and media generation, analytics, queues, security, and reliability. Provider outages, limits, policy changes, or discontinued services may affect ViralBatch.

Third-party sites and hosted payment pages have their own terms and privacy practices. ViralBatch is not responsible for third-party services outside its control.

Credits are internal usage units used to pay for supported generation. They are not legal tender, a deposit, stored value, or cash; have no cash-payout right; are usable only within ViralBatch; and are not transferable between accounts unless ViralBatch expressly introduces that capability. Generation cost varies by settings such as mode, resolution, and duration. The server-provided quote shown before submission controls the charge.

Accepted generation work reserves the quoted credits before it is queued and settles them only after the applicable successful lifecycle. A failed or safely cancelled generation that qualifies under the current settlement rules releases its reservation idempotently. That automatic release lifecycle does not create an automatic post-settlement refund for a completed generation.

Current Welcome Credits, Purchased Credits, and referral credits do not expire. Monthly subscription credits have separate rollover and cancellation rules. Optional Seedance-native narration currently adds no separate credit surcharge. ViralBatch may change future credit offers or prices prospectively, but historical ledger records remain part of the account history.

Pay As You Go is a one-time purchase available without a subscription. The current offer accepts whole-dollar purchases from $5 through $500 and grants 100 Purchased Credits per U.S. dollar after successful payment. The amount, resulting credits, applicable taxes, and hosted payment terms are shown before payment.

Failed, incomplete, or unverified payments do not grant credits. Purchased Credits currently do not expire and remain available after subscription cancellation, subject to continued account access and these Terms.

ViralBatch currently offers monthly Start, Scale, and Max plans. The current monthly offers are Start at $20 for 2,250 credits and 2 GB, Scale at $50 for 6,000 credits and 5 GB, and Max at $100 for 12,500 credits and 15 GB. Their rollover caps are respectively 2,250, 6,000, and 12,500 subscription credits. These terms are also presented in Billing and at hosted checkout. There is no current annual subscription or free trial.

A subscription renews at the recurring interval shown at checkout unless cancelled. A successful paid invoice creates the monthly credit allocation; a failed or past-due invoice does not create a new allocation. Supported plan changes are managed through the hosted billing portal. Stripe presents any billing adjustment, while the new ViralBatch credit allowance and rollover cap apply at the next paid entitlement period rather than creating an immediate full credit grant.

Unused subscription-origin credits may roll forward only up to one additional plan allowance at renewal. Cancelling normally stops renewal at the paid-through boundary shown in the billing portal. At that boundary, unused subscription credits expire. Purchased, eligible Welcome, and referral credits are not removed merely because the subscription ends.

A new user may optionally enter one referral code at signup. The resulting attribution is recorded once and cannot be changed. There are no referral links in the current program, and direct self-referral is prohibited.

If the referred account completes one successful qualifying U.S. dollar Pay As You Go or paid subscription purchase of at least $20 after discounts and excluding tax, the referrer and referred user each receive $5 worth of ViralBatch credits, currently 500 credits each. Smaller purchases do not accumulate. Each referred account can qualify once, while a referrer may refer an unlimited number of separate eligible accounts.

Referral rewards are non-transferable ViralBatch credits with no cash payout. Fraud, fake accounts, self-referral, payment manipulation, or other abuse may result in a pending reward being withheld and in account suspension or termination. The current system does not automatically remove already granted referral credits solely because a qualifying payment is later refunded or disputed. Any further account or credit action requires separate review.

ViralBatch may modify, suspend, or discontinue the referral program prospectively. Changes do not convert credits into cash or create a right to future rewards.

Stripe processes payments through hosted checkout and billing tools. ViralBatch does not ask you to enter full payment-card numbers into ViralBatch application forms. You authorize the one-time charges or recurring renewals presented by Stripe. Taxes and payment-method charges may apply where shown.

Cancelling a subscription does not itself reverse a completed purchase. ViralBatch does not make a blanket refund promise, and these Terms do not state that all sales are final. Contact support about a billing error, refund, chargeback, or dispute. Any available remedy depends on the facts, payment-provider state, these Terms, and applicable law.

ViralBatch and its software, interface, branding, documentation, Formulas, and service-created materials are protected by applicable intellectual-property laws. Except for the limited right to use the service under these Terms, no rights in ViralBatch property are transferred to you. Do not copy, reverse engineer, resell, or create derivative services from protected parts of ViralBatch except where applicable law permits it.

If you choose to send product feedback, you allow ViralBatch to use it without restriction or compensation to improve the service. This does not transfer ownership of your User Content.

ViralBatch may maintain, change, suspend, limit, or discontinue parts of the service. AI generation, Product imports, storage, authentication, queues, email, and billing depend on third-party services and may be delayed or unavailable. ViralBatch does not promise uninterrupted service, a fixed completion time, or that every request will succeed.

You may stop using ViralBatch and may manage an eligible subscription through the billing portal. We may suspend or terminate access when reasonably necessary to address a Terms violation, fraud, nonpayment, security risk, legal requirement, or material harm to the service or others.

Suspension or termination may prevent access to Products, media, generation history, and credits. This section does not create an automatic forfeiture rule for Purchased Credits. Payment obligations and provisions that by their nature should survive, including ownership, disclaimers, and limitations, continue after access ends.

To the fullest extent permitted by applicable law, ViralBatch is provided on an “as is” and “as available” basis. We do not guarantee that output will meet your expectations, be error-free, be unique, or be suitable or lawful for a particular purpose.

To the fullest extent permitted by applicable law, ViralBatch is not responsible for indirect, incidental, special, consequential, or punitive losses arising from use of the service, User Content, publication without appropriate review, third-party services, or events outside reasonable control. Nothing in these Terms excludes liability or consumer rights that applicable law does not permit us to exclude.

We may update these Terms as the service or legal requirements change. The effective date at the top identifies the current version. If a change materially affects your use, we will provide notice through a reasonable channel when required. Continued use after an updated version takes effect means you accept it.
